Gee Productions Service Agreement & Terms of Use

As a valued customer of Gee Productions, we want to ensure that you have the best experience possible while using our services. Please review these terms carefully. By using our services, you agree to be bound by the following conditions.

Section 1: AlgoRhythm Engine™ & Growth Services

These terms apply to all clients enrolled in our lead recovery and market growth services, including Music Instructors, DJs, Producers, Music Schools, and all Music Creator niches.

  1. Service Overview: Gee Productions provides a proprietary system known as the AlgoRhythm Engine™. This system uses advanced logic and tracking technology to identify anonymous website traffic and automate follow-up workflows.

  2. Lead Definition: A “lead” is defined as a prospective client or student identified by the AlgoRhythm Engine™ via de-anonymization technology or through the submission of a dedicated form with valid contact information (name, email, and/or phone number).

  3. Market Exclusivity (The Lock-In): Gee Productions offers 100% market exclusivity per niche and city. Once a territory is “Locked-In,” Gee Productions will not provide identical lead recovery or de-anonymization services to a direct competitor within that specific market for the duration of the active subscription.

  4. Right to Re-Assign Territory: Market Exclusivity is contingent upon an active, paid subscription. If a subscription is canceled or a payment fails for more than 48 hours, Gee Productions reserves the right to release the territory lock and offer the AlgoRhythm Engine™ data to other creators in that market without notice.

  5. Fees & Ad Spend: Standard lead generation fees are $997/month, billed in advance. Clients utilizing paid advertising (Meta/Google) are responsible for a separate ad spend budget (minimum $750/month) paid directly to the platform.

  6. Cancellation & Refunds: There are no long-term contracts. You may cancel anytime with 7 days’ notice before your next billing cycle. Due to the digital nature of real-time data delivery and ad services, all payments are non-refundable once a campaign has launched or data tracking has commenced.

  7. Performance & Non-Disparagement: We provide high-level data and proven automation, but we do not guarantee specific results such as enrollments, gig bookings, or revenue. Your success depends on your studio or brand’s offer and your timely follow-up. Clients agree not to disparage Gee Productions regarding lead conversion rates, as results are dependent on the client’s independent follow-up and sales ability.

  8. Data Use & Messaging Consent: By submitting your information or utilizing the system, you consent to receive email and SMS messages related to your account, territory status, and lead alerts. You may reply STOP to opt out at any time.

Section 2: Creative Services & SaaS (Smartzilla)

These terms apply to clients purchasing web design, branding, production, or accessing our CRM platform.

  1. Acceptance of Terms: By using Gee Productions services, you agree to be bound by these Terms and Conditions. We reserve the right to update these terms at any time.

  2. Use of Services: Our services are for personal and commercial use related to your business. You may not use our services for any illegal or unauthorized purpose. You are responsible for ensuring any content you provide is legal and does not violate copyright laws.

  3. Payment Terms:

    • Creative Projects: A 50% deposit is required to begin work, with the balance due upon completion.

    • Logo Design & Business Cards: Requires full payment before work begins.

    • Smartzilla (SaaS): Monthly subscription-based payment is required upfront to activate services. No refunds are provided for SaaS subscriptions.

  4. Ownership & IP Protection: All content created specifically for you (logos, websites, videos) remains your property upon final payment. However, all proprietary logic, internal workflows, “snapshots,” and automations within the AlgoRhythm Engine™ or Smartzilla platform remain the sole intellectual property of Gee Productions. You are not permitted to transfer these systems or data to any other platform.

  5. System Confidentiality: Clients agree to maintain the confidentiality of the internal logic and specific tools used within the AlgoRhythm Engine™ and shall not disclose such “secret sauce” methods to third parties.

  6. SaaS Usage & Connectivity: Customers are responsible for a stable internet connection and compatible devices. Gee Productions is not responsible for interruptions caused by the customer’s equipment.

  7. SaaS Phone Numbers & SMS Rates:

    • Phone Numbers: Local numbers are ~$1.15/mo; Toll-free is ~$2.15/mo.

    • A2P 10DLC: Clients are responsible for one-time and monthly carrier registration/vetting fees required by mobile carriers for SMS delivery.

    • Pay-Per-Use Rates: SMS is currently $0.0119 per segment; Email is $0.001013 per email. Rates are subject to change based on carrier adjustments.

  8. Limitation of Liability: Gee Productions will not be liable for any damages resulting from the use or inability to use our services, including direct or consequential damages. Governing law is the State of California.

Section 3: Creative Specifics (Logo & Print)

  1. Logo Design: Includes three rounds of revisions. Each additional round thereafter is $25. Once the logo is approved, we provide final files (PDF vector, JPG, and transparent PNG). No refunds.

  2. Business Cards: We provide samples based on references. It is the customer’s responsibility to proofread all content before printing. Once sent to print, no changes can be made and no refunds are issued.
